Photography Gallery Terms of Service

Welcome to CWenke Photography ("we," "us," or "our"). By accessing our website, purchasing prints, or engaging with our digital gallery, you ("User" or "Client") agree to be bound by the following terms.

1. Intellectual Property and Copyright

All photographic images, prints, and digital files displayed on this site are the exclusive property of CWenke Photography ("Photographer") and are protected by international copyright laws.

  • Ownership: The Photographer retains all rights, title, and interest in and to the images, including all copyrights.
  • No Transfer of Rights: Purchase of a physical print does not transfer copyright, reproduction rights, or commercial usage rights to the buyer.

2. Usage Rights

  • Personal Use Only: Prints purchased are for personal, non-commercial display only.
  • Restrictions: You may not scan, reproduce, alter, edit, filter, or resell the images in any form without express written permission from the Photographer.
  • Digital Files: If digital files are provided, they are licensed for personal use only (e.g., printing for home, personal social media). Digital images may not be sold or sub-licensed.

3. Purchases, Payments, and Shipping

  • Pricing and Payment for prints: are done through a third party shipper and are subject to their own terms and conditions.
  • Shipping & Delivery: Estimated shipping times are provided by the print contractor. We are not responsible for delays, errors or lost photographs caused by shipping carriers. All orders of photos are the responsibility of the printing contractor and should be addressed with them.

4. Limitation of Liability

  • Display Variation: Colors and contrast may vary slightly between your monitor display and the final print due to screen settings.
  • Liability Limit: The Photographer is not liable for any loss, damage, or costs arising from the use of the images. The total liability will not exceed the total amount paid by the Client.

6. Governing Law

These Terms of Service are governed by the laws of Kansas/USA. Any disputes arising from these terms will be resolved in the courts of Wichita/Sedgwick County.

 

Client will indemnify, defend, and hold harmless, Photographer, his contractors, and his representatives, against any and all claims, liabilities, damages, costs, and expenses, including reasonable legal fees and expenses, that may arise from Client’s use of any Image(s).


Information Collection

  • We collect your email address and PIN entry when you access your gallery.
  • This information is used solely to verify your identity and track successful delivery of your photos.

Data Processors

  • Your data is processed through Pixieset Media Inc., our hosting provider.
  • We do not sell or share your contact information with any other third parties.

Cookies

  • Pixieset uses cookies to remember your gallery preferences and "liked" photos. You can manage these through your browser settings.

Data Retention

  • Your contact information (email) associated with the gallery will be stored for the two-year life of the gallery to ensure you can receive support or re-access your files.
